10 Most Common Questions About Drafting a Will

March 4, 2020 · Personal finance

Who has the right to contest my will?

Wills are contested more often than you might think. Any beneficiary, including spouses, ex-spouses or children might challenge your wishes that could go against local probate laws. The bottom line that anyone who feels slighted can dispute all or part of your will.

Furthermore, if it wasn’t properly witnessed, if it’s the result of fraud or coercion or if you weren’t competent when you signed it, your will might be contested too. In order for a judge to even start settling the dispute, there needs to be a legitimate legal fault with your documents. That’s why, if you wish to ensure that nothing is out of place in order to avoid this altogether, you should consult with a lawyer.
