8. Claim on an Ex-Spouse’s Record if You Meet the Requirements
Divorce does not necessarily erase your ability to leverage a former partner’s earnings history. If your marriage lasted for 10 consecutive years or more, and you are currently unmarried, you may be eligible to claim a divorced spousal benefit based on your ex’s work record. Similar to current spousal benefits, this can equal up to 50% of their FRA amount.
Many divorcees hesitate to pursue this route out of a desire for privacy or ongoing friction. Rest assured, claiming on an ex-spouse’s record requires absolutely no interaction with them. The SSA handles the process internally, your ex-spouse is never notified of your claim, and your draw has zero impact on their benefits or the benefits of their current spouse.
